XPAND Code is provided by XPAND K.K. (Hereinafter referred to as the "Company"), located in Japan.
The following Terms and Conditions of Use (the "Terms of Use") constitute a legal agreement between the XPAND Code and related services (the "Service") user (the "User") and the Company. The original Terms of Use is in Japanese.
By using the Service, the User agree to these Terms of Use; if the User do not agree, do not use the Service.
The Company reserves the right to make changes to these Terms of Use at any time and at its discretion. If the User do not agree with such changes the User should cease using the Service. The User's continued use of the Service after any such changes to the Terms of Use shall be deemed acceptance of any such new or modified terms.
Using the Service
Subject to these Terms of Use, the User is granted the right to use the Service. To the extent the User choose to use the Service, the User do so at the User's own initiative and agree to use the Service only as permitted by these Terms of Use.
The Company may suspend or stop providing the Service to the User if the User do not comply with the Company's terms or policies.
Prohibited Conduct
The User may not:
1)interfere with the Service or try to access it using a method other than the interface and the instructions that the Company provide;
2)convert issued XPAND Code Gratis to vector data or make changes other than scaling;
3)make changes to the issued XPAND Code Pro other than scaling, color scheme, or file format;
4)any use that violates or may violate the laws of each country / region
5)any use that the Company deems inappropriate, such as violating public order and morals, or defaming the Company’s honor or interest;
6)reproduce, modify, translate, or create derivative works of the Service or any portion thereof without the Company’s permission;
7)rent, lease, loan, sublicense, publish, transfer, sell, or redistribute access to or use of the Service, or any portion thereof, in any manner without the Company’s permission;
Cancellation / Refund
The Service cannot be canceled or refunded after applying for a paid service. However, this does not apply to cases where the contract was not successfully executed, such as illegal use of a credit card.
With the Service, the contract is automatically renewed whenever the contract expires. The User can stop automatic updates at any time from the control panel. If automatic renewal is stopped, it will be downgraded to the free service as soon as the validity period is reached.
If the User would like to cancel the service completely instead of downgrading, the User can request it via the contact form.
Privacy
When using the Service, the information the Company obtain from the User (the "User Information") is limited to the followings:
1) XPAND Code Gratis - HTTP request header, IP address, and cookie identifier sent from the terminal;
2) XPAND Code Pro - Email address in addition to the above;
When using the XPAND Code, the Company does not track the User with cookies, and do not pass the User Information outside the Company. However, the Company is not involved in the acquisition or processing of user information in services provided by third parties, such as advertising distribution programs and destination content. It is decided by each operator.
Intellectual Property Right
Using the Service does not give the User ownership of any intellectual property rights in the Service. These Terms of Use do not grant the User the right to use any trademarks, brands, or similar intellectual property rights associated with the Service.
Limitation of Liability
The Company’s policy regarding damages or losses resulting from the Service is as follows:
1) the Company is not responsible for the free version;
2) the Company is responsible for the paid version up to the billing amount;
Controlling Law and Venue
These Terms of Use will be governed by and construed in accordance with the laws of Japan. In the event of a dispute between the Company and the User, the Tokyo District Court shall have exclusive primary jurisdiction with respect to all disputes arising with respect thereto.
Use of Cookies
This website uses cookies. Cookies are not used for the purposes of ad delivery and user tracking. The purpose of use is as follows:
1)improved user-friendliness such as display in user language and session management during transitions between pages;
2)prevention of attacks and unauthorized use;
3)cooperation with payment system;
4)access analysis (not an external service such as Google Analytics but an analysis system in our server);
